Terms of Service

By accessing or using Calibr8, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

You must be at least 16 years old to create an account and use Calibr8.

If you are between 16 and 18, you represent that you have your parent or guardian's permission to use the Service.

You must provide accurate and complete information during registration.

You are responsible for maintaining the confidentiality of your account credentials.

You agree to notify us immediately of any unauthorized access to your account.

You are responsible for all activities that occur under your account.

One account per person. Do not share your account or create multiple accounts.

Calibr8 is a digital SaaS (Software as a Service) product, available as a web application and as an iPhone app, that provides personalized nutrition tracking and planning tools including calorie and macro calculations, food logging, progress tracking, and AI-powered analytics.

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

We may modify, suspend, or discontinue features of the Service at any time.

We do not guarantee uninterrupted access. The Service is provided "as is" and "as available."

IMPORTANT: Calibr8 provides general nutrition education and tracking tools. It does not provide medical advice, diagnosis, or treatment.

The nutrition recommendations are based on general guidelines and your self-reported data. They are not tailored to specific medical conditions.

Always consult a qualified healthcare provider, registered dietitian, or physician before starting any diet program, especially if you have diabetes, eating disorders, kidney disease, or other medical conditions.

If you experience adverse symptoms while following any recommendations, stop immediately and seek medical attention.

We are not liable for any health outcomes resulting from your use of the Service.

You agree not to: use the Service for any illegal purpose; attempt to gain unauthorized access to any part of the Service; interfere with the proper functioning of the Service; upload malicious code or content; impersonate others or misrepresent your affiliation.

You agree not to scrape, data mine, or use automated tools to access the Service without our written permission.

We reserve the right to suspend or terminate accounts that violate these rules.

The Service, including its design, features, content, and underlying technology, is owned by Calibr8 Nutrition and protected by intellectual property laws.

Your Content: You retain ownership of the data you input (food logs, measurements, etc.). By using the Service, you grant us a license to use this data to provide and improve the Service.

You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent.

Calibr8 offers free and paid subscription plans. Paid plans provide additional features as described on our pricing page.

Calibr8 Premium is sold in two places: on our website and inside the Calibr8 app for iPhone. Where you bought your subscription decides who sold it to you, how you cancel it and who refunds it. This section covers purchases made on the website; the next section covers purchases made through the App Store.

Subscriptions bought on the website are sold by Calibrate EOOD, and payment is processed securely through Stripe, our payment processor.

A subscription bought on the website renews automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings, and the cancellation takes effect at the end of the current billing period.

For subscriptions bought on the website, Calibr8 offers a 30-day money-back guarantee from your first charge. Outside this window, refunds are generally not provided for partial billing periods, except where required by law.

We reserve the right to change pricing with 30 days notice. Price changes do not affect your current billing period.

If you buy Calibr8 Premium inside the Calibr8 app for iPhone, you buy it from Apple. Apple is the seller of record for that purchase, Apple's own terms apply to it alongside these Terms, and Apple's refund policy governs any refund of it.

The subscription is called Calibr8 Premium and is offered for a period of one month or one year. The price for your country, including VAT, is shown on the purchase screen before you confirm.

Payment is charged to your Apple Account when you confirm the purchase.

The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.

An App Store subscription is managed and cancelled in your Apple Account settings, not in Calibr8: on the iPhone, open Settings, tap your name, then tap Subscriptions. Deleting the app does not cancel the subscription.

If a free trial is offered and you take it, any unused part of it is forfeited when you buy a subscription. Whether you are eligible for a trial is Apple's decision, and the eligibility is granted once per Apple Account.

Refunds for App Store purchases are requested from Apple at reportaproblem.apple.com and are decided by Apple. We cannot issue them ourselves. Write to support@calibr8nutrition.com and we will help you with the request.

The 30-day money-back guarantee described above applies to purchases made on calibr8nutrition.com and does not cover App Store purchases.

To the maximum extent permitted by law, Calibr8 and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

You may delete your account at any time through your account settings or by contacting us.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or upon your request.

Upon termination, your right to use the Service ends immediately. We will delete your personal data as described in our Privacy Policy.

Provisions that by their nature should survive termination (such as intellectual property, limitation of liability) will remain in effect.

These Terms are governed by the laws of the European Union and the country where you reside.

Any disputes shall first be attempted to be resolved through good-faith negotiation.

If negotiation fails, disputes shall be resolved through the courts of your country of residence within the EU, or through alternative dispute resolution if both parties agree.

For users in the EU, you may also access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/odr.

If you bought your subscription through the App Store, that purchase is additionally subject to Apple's terms and to Apple's refund policy, and Apple is the seller of record for it.
